You didn’t read the article carefully enough. The parish not only got its money back, it also received a financial settlement from the priest.

Regarding the Matter of Milo Yiannopoulos

While I agree with Monk James that there is no evidence that a minor sexually assaulted by an adult male “causes” same sex attraction, I take issue with his definition of “statutory rape.” Statutory rape — that is, for an adult to have sex with a minor — is a crime. It’s a **crime,** not a relationship, and consent is not a defense. A child below the age of majority is incapable of giving meaningful consent.

If you are talking about Pokrov.org, you are mistaken:

I believe that you are mistaken. In the 1990s when Archimandrite Hilary Madison was living at the monastery in Calistoga, California, it was a stavropegial institution. It was not until some years later that the monastery was transferred to the Diocese of the West.

BTW, the archimandrite was listed was the “priest-in-charge” of Holy Assumption Monastery in the 1994 OCA yearbook that I have.

Metropolitan Jonah has never been publicly accused of sexual abuse or sexual misconduct, AFAIK, so he does not meet the criteria for inclusion on that page.

“After careful reflection and prayerful discussion…” Archmandrite Gerasim’s Election Put On Hold

Maria von Trapp is correct, as the Synod conceded on February 6, 2015 (http://oca.org/news/headline-news/court-upholds-conviction-of-archbishop-seraphim):

“The process leading to a spiritual court will commence as mandated by the Canons of the Orthodox Church and by the Policies on Sexual Misconduct of the Orthodox Church in America, the latter of which require that clergy who have been convicted of child sexual abuse be deposed by the Holy Synod of Bishops.”

Your reading of the policy is incomplete, OOM.

Section 9.10(C) says:

“For all purposes under these Policies, Standards and Procedures, and for purposes of any Final Decision, conviction of a Cleric or Lay Worker of a criminal offense arising out of the same or similar events that are the subject of a complaint herein, is conclusive proof of the commission of the criminal offense and is conclusive evidence that allegations which correspond to those contained in the criminal offense in the Complaint have been substantiated.”

Section 10.05(B) says:

“Any Clergy who admits or is found to have committed child sexual abuse shall be suspended by the applicable Ruling Bishop, shall be deposed by the Holy Synod of Bishops, and shall be permanently prohibited from exercising any functions or responsibilities of parish ministry.”

I don’t believe that criminal charges were ever filed in New York. However, a court in Florida did accept former priest Robert Kondratick’s guilty plea to charges he embezzled $50,000 from Holy Spirit Orthodox Church in Venice.

OCA: Sentence announced in Archbishop Seraphim case

You are certainly entitled to believe that Archbishop Seraphim Storheim is “completely innocent.” However, to my knowledge, no lawsuit has been filed in this case. Your accusation that these men are only after money is, at best, premature.

Whatever Archimandrite Isidore Brittain **might** have been doing vested at the Corvallis parish, the fact remains that the SMPAC report asserted that he was serving in the Diocese of the West. Again, I have seen nothing that refutes this claim.

Moreover, there is also this tidbit from the Newport News Times of February 4, 2011:

I only know what the SMPAC reported. I have seen nothing to refute their assessment that Archimandrite Isidore Brittain was transferred to the Diocese of the West and was serving at the Corvallis parish despite being under suspension.

I don’t understand what was going on either. I can only suggest that you read the section of the SMPAC report pertaining to Archimandrite Isidore Brittain, Father George. It was the committee’s assertion that Brittain was serving — not simply vested — despite his suspension. To my knowledge, that assertion has never been refuted.

A good question. But I’m not the person who can, or who needs to, answer that.

It is a fact that Archimandrite Isidore Brittain was suspended for following Bishop Nikolai Soraich to Australia. There has never been an announcement that the suspension was lifted, nor has Brittain’s name ever reappeared on the OCA clergy list.

To the contrary, according to the SMPAC report, Brittain was still under suspension when he was released to the Diocese of the West and allowed to serve at St. Anne’s.

Archimandrite Isidore Brittain was suspended by Metropolitan Herman Swaiko when he followed Bishop Nikolai Soraich to Australia without permission. The suspension has never been lifted.

This Just In: Dokos to Face Charges on May 16

Pokrov.org (or more specifically, SNAP, the Survivors Network of those Abused by Priests) clearly had no influence on the decision of the St. Raphael of Brooklyn’s parish to bar the former Subdeacon Robert Aaron Mitchell from the church. According to Archbishop Nathaniel Popp, that decision was reached at some time prior to March 30th of this year.

SNAP issued their first press statement on Mitchell on April 3rd. On that day we wrote to the archbishop asking him whether a registered sex offender was serving as one of his subdeacons. The letter linked above was his response to our query.

Moreover, the parish was also clearly not banning Mitchell because of what Mr. Stankovich terms “disinformation, myth, and … unsupported contentions.” By that point in time, Mitchell had **already reoffended.** As the archbishop wrote, “The allegations of sexual misconduct with a minor were substantiated.”

We can’t single out Illinois. Penalties for offenses against the innocent nationwide are often lighter than would seem to be appropriate.

I don’t know how long Mitchell was incarcerated prior to his conviction, but this time would have been subtracted from his sentence. I do know that Mitchell’s conviction followed a jury trial and was not based on a custody dispute. Moreover, I have been told that the allegations brought to the Romanian Episcopate of the OCA involved behavior very similar to that which resulted in the Illinois conviction. According to Archbishop Nathaniel Popp, the parish decided that Mitchell was no longer welcome in the church after the internal investigation substantiated the allegations.
